The Insolvency and Bankruptcy Code, 2016 (IBC) provides a market mechanism for reorganisation and insolvency resolution of corporate persons, partnership firms and individuals in a time bound manner for maximization of value of assets of such persons, to promote entrepreneurship, availability of credit and balance the interests of all the stakeholders. It is one of the deepest economic reforms of India in the recent years. Elucidating its importance, the Hon’ble Prime Minister in his address at the centenary celebrations of Kirloskar Group on 6th January, 2020 observed:
“साथियो,आजकल Insolvency और Bankruptcy Code IBC की इतनी चर्चा होती है, लेकिन ये सिर्फ इतना पैसा वापस आया, उतना पैसा वापस आया- वहां तक ही सीमित रहती है। लेकिन वो उससे भी आगे है। आप सभी ये बेहतर जानते हैं कि कुछ स्थितियों में धंधे से बाहर निकलना ही कई बार समझदारी माना जाता है। ये जरूरी नहीं कि जो कंपनी सफल न हो रही हो, उसके पीछे कोई साजिश ही हो, कोई गलत इरादा हो, कोई लालच होए,ये जरूरी नहीं है। देश में ऐसे उद्यमियों के लिए एक रास्ता तैयार करना आवश्यक था और IBC ने इसका आधार तय किया । आज नहीं तो कल, इस बात पर अध्ययन जरूर होगा कि IBC ने कितने भारतीय उद्यमियों का भविष्य बचाया, उन्हें हमेशा-हमेशा के लिए बर्बाद होने से रोका।”
The Insolvency and Bankruptcy Board of India (IBBI) is a key pillar of the ecosystem responsible for implementation of the IBC. It is responsible for development and regulation of insolvency professionals and other service providers. It regulates various processes, namely, corporate insolvency resolution, corporate liquidation, fresh start, individual insolvency resolution and individual bankruptcy. It acts as the ‘Authority’ for regulation and development of the profession of valuers.
To promote awareness and understanding of the IBC among various stakeholders (Indian citizens) across the country, the IBBI has launched this online Quiz in collaboration with MyGov.
दिवाला और दिवालियापन संहिता, 2016 (आईबीसी) उद्यमिता को बढ़ावा देने, ऋण की उपलब्धता और ऐसे व्यक्तियों की संपत्ति के मूल्य को अधिकतम करने के लिए समयबद्ध तरीके से कॉर्पोरेट व्यक्तियों, साझेदारी फर्म और व्यक्तियों के पुनर्गठन, सभी हितधारकों के हितों को संतुलित करने और दिवाला समाधान के लिए एक बाजार तंत्र प्रदान करता है। यह हाल के वर्षों में भारत के सबसे गहरे आर्थिक सुधारों में से एक है। इसके महत्व पर प्रकाश डालते हुए, माननीय प्रधानमंत्री ने 6 जनवरी, 2020 को किर्लोस्कर समूह के शताब्दी समारोह में अपने संबोधन में कहा:
“साथियो, आजकल Insolvency और Bankruptcy Code IBC की इतनी चर्चा होती है, लेकिन ये सिर्फ इतना पैसा वापस आया, उतना पैसा वापस आया- वहां तक ही सीमित रहती है । लेकिन वो उससे भी आगे है । आप सभी ये बेहतर जानते हैं कि कुछ स्थितियों में धंधे से बाहर निकलना ही कई बार समझदारी माना जाता है । ये जरूरी नहीं कि जो कंपनी सफल न हो रही हो, उसके पीछे कोई साजिश ही हो, कोई गलत इरादा हो, कोई लालच होए, ये जरूरी नहीं है । देश में ऐसे उद्यमियों के लिए एक रास्ता तैयार करना आवश्यक था और IBC ने इसका आधार तय किया । आज नहीं तो कल, इस बात पर अध्ययन जरूर होगा कि IBC ने कितने भारतीय उद्यमियों का भविष्य बचाया, उन्हें हमेशा-हमेशा के लिए बर्बाद होने से रोका।”
भारतीय दिवाला और दिवालियापन बोर्ड (IBBI) आईबीसी के कार्यान्वयन के लिए जिम्मेदार इकोसिस्टम का एक प्रमुख स्तंभ है। यह दिवाला पेशेवरों और अन्य सेवा प्रदाताओं के विकास और विनियमन के लिए जिम्मेदार है। यह विभिन्न प्रक्रियाओं को नियंत्रित करता है, अर्थात् कॉर्पोरेट दिवाला समाधान, कॉर्पोरेट परिसमापन, नई शुरुआत, व्यक्तिगत दिवाला समाधान और व्यक्तिगत दिवालियापन। यह मूल्यांकनकर्ताओं के पेशे के विनियमन और विकास के लिए ‘प्राधिकरण’ के रूप में कार्य करता है।
देश भर में विभिन्न हितधारकों (भारतीय नागरिकों) के बीच आईबीसी के बारे में जागरूकता और समझ को बढ़ावा देने के लिए, IBBI ने MyGov के सहयोग से यह ऑनलाइन क्विज़ लॉन्च किया है।
1. The Quiz shall be open on the MyGov portal for a period of one month from 1st August, 2024 to 31st August, 2024. / क्विज़ 1 अगस्त, 2024 से 31 अगस्त, 2024 तक एक महीने की अवधि के लिए MyGov पोर्टल पर खुला रहेगा।
2. The Quiz is open to Indian citizens aged 18 years and above as on 1st August, 2024. Individuals working in IBBI and BSE Investors Protection Fund (permanent and contractual), service providers under the IBC and registered with IBBI and also their immediate family members are not eligible to participate in the Quiz. A participant is required to self-certify that he/she is eligible to take the Quiz and also that he/she abides by these terms and conditions. / क्विज़ 1 अगस्त, 2024 तक 18 वर्ष और उससे अधिक आयु के भारतीय नागरिकों के लिए खुला है। आईबीबीआई और बीएसई इन्वेस्टर्स प्रोटेक्शन फंड (स्थायी और संविदात्मक) में काम करने वाले व्यक्ति, आईबीसी के तहत सेवा प्रदाता और आईबीबीआई के साथ पंजीकृत और उनके तत्काल परिवार के सदस्य क्विज़ में भाग लेने के पात्र नहीं हैं। एक प्रतिभागी को स्व-प्रमाणित करना आवश्यक है कि वह क्विज़ लेने के लिए पात्र है और यह भी कि वह इन नियमों और शर्तों का पालन करता है।
3. A participant needs to register on the MyGov portal before taking the Quiz. For registration, the participant needs to submit a valid mobile number and a valid e-mail ID. The same mobile number or email ID cannot be used twice for registration. This means that a participant can participate in the Quiz only once. In case of same mobile number/email id being used multiple times, only the first entry will be considered eligible, and the remaining entries will be eliminated. / क्विज़ में भाग लेने से पहले प्रतिभागी को माईगव पोर्टल पर पंजीकरण करना होगा। पंजीकरण के लिए, प्रतिभागी को एक वैध मोबाइल नंबर और एक वैध ई-मेल आईडी जमा करना होगा। पंजीकरण के लिए एक ही मोबाइल नंबर या ईमेल आईडी का दो बार उपयोग नहीं किया जा सकता है। इसका मतलब यह है कि एक प्रतिभागी केवल एक बार ही क्विज़ में भाग ले सकता है। एक ही मोबाइल नंबर/ईमेल आईडी का कई बार उपयोग करने की स्थिति में केवल पहली प्रविष्टि को ही पात्र माना जाएगा, और शेष प्रविष्टियों को हटा दिया जाएगा।
4. The Quiz is available both in English and Hindi. A participant may choose either of the languages. / क्विज़ अंग्रेजी और हिंदी दोनों में उपलब्ध है। एक प्रतिभागी इनमें से कोई भी भाषा चुन सकता है।
5. The Quiz will have 20 (twenty) multiple choice questions, each carrying one mark. A participant will get 10 (ten) minutes to complete the Quiz. There will be no negative marking. / क्विज़ में 20 बहुविकल्पीय प्रश्न होंगे, प्रत्येक प्रश्न एक अंक का होगा। एक प्रतिभागी को क्विज़ पूरा करने के लिए 10 मिनट मिलेंगे। कोई नेगेटिव मार्किंग नहीं होगी।
6. Any kind of malpractice, such as, impersonation, double participation, etc., will render the participation of the individual null and void. / किसी भी प्रकार का कदाचार, जैसे प्रतिरूपण, दोहरी भागीदारी, आदि, व्यक्तिगत भागीदारी को अमान्य कर देगा।
7. Performance in the Quiz will be evaluated based on “Maximum Correct Answers in the Shortest Time”. For example, if many individuals secure 20 marks, they will be ranked on the basis of the time taken to complete the Quiz, as electronically determined. The individual, who has completed the Quiz at the earliest shall be considered the best performer. After ranking the individuals with score of 20, the individuals with score of 19 will be ranked, and so on. / क्विज़ में अंक का मूल्यांकन “कम से कम समय में अधिकतम सही उत्तर” के आधार पर किया जाएगा। उदाहरण के लिए, यदि कई व्यक्ति 20 अंक प्राप्त करते हैं, तो उन्हें इलेक्ट्रॉनिक रूप से निर्धारित क्विज़ को पूरा करने में लगने वाले समय के आधार पर रैंक किया जाएगा। जिस व्यक्ति ने क्विज़ को जल्द से जल्द पूरा कर लिया है, उसे सर्वश्रेष्ठ प्रतिभागी माना जाएगा। 20 अंक वाले व्यक्तियों की रैंकिंग के बाद, 19 अंक वाले व्यक्तियों की रैंकिंग की जाएगी, इत्यादि।
8. The best performer will be awarded a Gold Medal along with a cash prize of ₹ 1,00,000/- (One lakh rupees only). The second-best performer will be awarded a Silver Medal along with a cash prize of ₹ 50,000/- (Fifty thousand rupees only). The third best performer will be awarded a Bronze Medal along with a cash prize of ₹ 25,000/- (Twenty five thousand rupees only). The next ten best performers will be awarded consolation prizes of ₹ 10,000/- (Ten thousand rupees only) each. These prizes and medals are sponsored by BSE Investors Protection Fund, as part of its investor awareness initiatives. These prizes and medals will be given away at an appropriate function to be decided by the IBBI. / सर्वश्रेष्ठ प्रदर्शन करने वाले प्रतिभागियों को स्वर्ण पदक के साथ-साथ ₹ 1,00,000/- का नकद पुरस्कार दिया जाएगा। दूसरे सर्वश्रेष्ठ प्रदर्शन करने वाले को रजत पदक के साथ-साथ ₹ 50,000/- का नकद पुरस्कार दिया जाएगा। तीसरे सर्वश्रेष्ठ प्रतिभागी को कांस्य पदक के साथ-साथ ₹ 25,000/- के नकद पुरस्कार से सम्मानित किया जाएगा। अगले दस सर्वश्रेष्ठ प्रदर्शन करने वालों में से प्रत्येक को ₹ 10,000/- के सांत्वना पुरस्कार से सम्मानित किया जाएगा। ये पुरस्कार और पदक बीएसई इन्वेस्टर्स प्रोटेक्शन फंड द्वारा निवेशक जागरूकता पहल के हिस्से के रूप में प्रायोजित किए जाते हैं। ये पुरस्कार और पदक आईबीबीआई द्वारा तय किए जाने वाले उचित समारोह में दिए जाएंगे।
9. After the closure of the Quiz, and prior to the announcement of results, the winners of cash prizes will be required to provide their identity details. Non-submission of these details will render their participation null and void and the next best performer will be chosen accordingly. The entries, if any, of cash prize winners of 1st, 2nd, 3rd and 4th National Online Quiz, organized by IBBI in 2020, 2021, 2022 and 2023 respectively, will not be considered for award of cash prizes. / क्विज़ के समापन के बाद, और परिणामों की घोषणा से पहले, नकद पुरस्कार के विजेताओं को अपनी पहचान का विवरण प्रदान करना आवश्यक होगा। इन विवरणों को प्रस्तुत न करने पर उनकी भागीदारी शून्य हो जाएगी और अगला सर्वश्रेष्ठ प्रदर्शन करने वाले को तदनुसार चुना जाएगा। आईबीबीआई द्वारा क्रमशः 2020, 2021, 2022 और 2023 में आयोजित प्रथम, द्वितीय, तृतीय और चतुर्थ राष्ट्रीय ऑनलाइन क्विज़ के नकद पुरस्कार विजेताओं की प्रविष्टियाँ, यदि कोई हों, नकद पुरस्कार के लिए विचार नहीं किया जाएगा।
10. In case of any dispute, the decision of the IBBI shall be final. / किसी भी विवाद की स्थिति में आईबीबीआई का निर्णय अंतिम होगा।
11. By participating in the Quiz, the participant agrees to have read and accepted the above-mentioned terms and conditions. / क्विज़ में भाग लेने से, प्रतिभागी उपर्युक्त नियमों और शर्तों को पढ़ने और स्वीकार करने के लिए सहमत होता है।
